Terms & Conditions

These Terms govern your use of the Tongkaboti Nature Retreat website, all online and offline bookings, and your participation in any stays, activities or events offered at or through the property. By accessing the website, making a booking, or entering the property, you agree to be bound by these Terms.

Operator & Contact Details

Tongkaboti Nature Retreat (“Resort”, “we”, “us”, “our”) operates all Services described in these Terms.

Location

Babunagarpara, Ward No. 3, Tongkaboti, Bandarban, Bangladesh

All Services are operated in accordance with the applicable laws of the People’s Republic of Bangladesh.

Scope of These Terms

These Terms apply to:

  • Use of our website and online booking system
  • Room, cottage and accommodation bookings
  • Food & beverage and other on-site resort services
  • Outdoor and adventure activities operated from or within the property (including hiking, nature walks, treetop courses, rope activities, ground challenges, kids play zones, archery, and ATV/UTV or other trail rides where offered)
  • Any events, corporate retreats, school trips or group programmes held at the property

Additional activity-specific rules, waivers or house rules may apply. In case of conflict, those activity-specific terms will apply to that activity, together with these Terms.

Eligibility & Guest Responsibility

By using our Services, you confirm that you:

  • Are at least 18 years old and legally capable of entering into a binding contract
  • Are making bookings only for yourself and/or others with their permission
  • Will provide accurate, complete and current information

If you book on behalf of other guests (family, group, company, school, etc.), you:

  • Confirm that you are authorised to act for them
  • Agree to ensure they receive and comply with these Terms and all posted house rules

Booking & Payment Policy

Full payment at time of booking

Full payment (100%) is required at the time of booking for all room and accommodation reservations, and for all activity or package bookings.

A booking is considered confirmed only when payment has been successfully received and a booking confirmation or booking ID has been issued by us or our authorised booking partner.

We may cancel any booking that is unpaid, partially paid, reversed, disputed, fraudulent, or submitted with incorrect information.

Guest information & ID

  • You must provide accurate guest details (names, contact numbers, email, number of guests, special requests).
  • All adult guests should present a valid government-issued photo ID (e.g. NID, passport) at check-in.
  • For certain activities (e.g. ATV/UTV), a valid driving licence may be required for drivers.

Rates, taxes & fees

  • Rates are quoted in Bangladeshi Taka (BDT) and may include or exclude VAT, service charges and other government levies.
  • Inclusions (room only, breakfast, packages, activities, etc.) will be shown at the time of booking.
  • We reserve the right to correct obvious pricing errors and adjust rates if taxes, regulations or charges imposed by authorities change.

Cancellations, Rescheduling & Refunds

Accommodation bookings

7+ days before check-in

Full refund (less bank/payment gateway charges), or full credit for a future stay.

3–6 days before check-in

50% of the total booking is charged; the remaining 50% may be refunded or converted to credit at our discretion.

Under 72 hours or no-show

100% of the total booking is charged. No refund or credit.

A “no-show” means failing to arrive on the check-in date without prior written cancellation within the applicable time window.

ATV/UTV and similar high-demand activities

72+ hours before

Full refund or full credit.

48–72 hours before

50% refund or credit; 50% forfeited.

Under 48 hours or no-show

No refund or credit.

Other activities

24+ hours before

Full refund or full credit.

Under 24 hours or no-show

No refund or credit.

Treetop, ground games, kids zone

The windows above apply to all non-ATV/UTV activity bookings.

Rescheduling

  • Rescheduling is subject to availability for your new date/time and to the applicable reschedule windows above.
  • As a general rule only one reschedule per booking is allowed. Additional changes may be treated as cancellations.

Refund processing

  • Approved refunds are usually processed back to the original payment method.
  • Bank or payment gateway fees, currency conversion fees or processing charges may be deducted.
  • Refund timelines depend on your bank or gateway; we are not responsible for delays on their side.

Check-In, Check-Out & Late Arrival

  • Early check-in and late check-out are subject to availability and may incur additional charges.
  • For activities such as ATV/UTV or treetop courses, guests must arrive at least 30 minutes before the scheduled start time for check-in, safety briefing and gear fitting.
  • Late arrival may result in refusal of participation, treated as a no-show with no refund.

Zero-Tolerance: Drugs & Alcohol

The possession, use, sale, purchase or distribution of any illegal drugs or controlled substances, and any alcoholic beverages of any kind, is strictly prohibited anywhere on the property — including rooms, common areas, outdoor zones, trails, vehicles and activity areas.

Guests are not allowed to bring or consume alcohol on the premises under any circumstances.

If any guest, member of their party, or visitor is found or reasonably suspected to possess, use, sell or distribute drugs or alcohol, or to be under the influence, the Resort may at its sole discretion:

  • Immediately terminate the stay and/or activity booking
  • Evict the guest and their entire party from the property, and/or refuse participation in any activities
  • Withhold any refund or credit for unused nights or activities
  • Report the matter to law enforcement authorities in accordance with Bangladeshi law

The decision of Resort management on such matters is final, and by booking you agree that eviction without refund is a reasonable consequence of violating this policy.

Risk Acknowledgment & Waiver

The Resort is located in hilly, forested terrain with natural features such as slopes, mud, loose stones, wildlife and changing weather conditions. By staying or participating in any activity you understand that there are inherent risks which cannot be completely eliminated.

For certain activities (including ATV/UTV rides, treetop and rope courses, ground challenges, archery and similar adventure experiences), guests may be required to sign a separate risk acknowledgment and waiver before participating. If you refuse to sign, you will not be allowed to join the activity, and any refund will follow the applicable cancellation policy.

By participating in any activity, you agree that:

  • You do so voluntarily and at your own risk
  • You have been informed of and understand the nature of the activity and its risks (including injury, falls, collisions, equipment failure, environmental hazards and other unforeseen events)
  • To the maximum extent permitted by law, the Resort is not liable for personal injury, property damage or accidents arising from participation, except where directly caused by our gross negligence

Participant Requirements

Certain activities have minimum age, height, weight or skill requirements, which will be communicated during booking or at check-in. Example guidelines:

  • ATV drivers: minimum 18+, valid motorcycle licence where required.
  • UTV drivers: minimum 18+, valid driving licence where required; passengers allowed as per vehicle capacity.
  • Treetop, rope and ground challenges: participants must be reasonably fit. Not suitable for guests with serious heart conditions, uncontrolled epilepsy, recent major surgery, or other conditions making such activity unsafe.

We reserve the right to refuse participation if, in our reasonable judgment, a guest is unfit, not following instructions, or presents a safety risk to themselves or others. No refund is due in such cases if caused by the guest’s own behaviour or omission.

Safety Rules & Equipment

For all activities, guests must:

  • Attend mandatory safety briefings
  • Wear required safety gear (helmets, harnesses, gloves, etc.)
  • Follow staff and guide instructions at all times
  • Stay within designated trails or activity zones
  • Not perform stunts, races or reckless manoeuvres
  • Not use mobile phones, headphones, cameras or other distractions while operating vehicles, unless specifically allowed by staff in a safe manner

We may immediately stop any activity for a guest who refuses to follow instructions, behaves in a reckless or unsafe way, or appears to be under the influence of drugs, alcohol or extreme fatigue. No refund is due if an activity is stopped for these reasons.

Damage, Loss & Security Deposit

Guests are responsible for any damage to:

  • Rooms, furniture, fixtures or décor
  • Common areas and landscape
  • Activity equipment (ATVs, UTVs, harnesses, helmets, etc.)
  • Any property of the Resort caused by them or by members of their party, including children

The Resort may charge a security deposit at check-in, deduct from the deposit or charge your card for repair, replacement or extra cleaning, and impose additional penalties in cases of reckless damage or misconduct.

The Resort is not responsible for loss or theft of cash, jewellery, documents, electronics or other valuables left in rooms or public areas. Guests are encouraged to keep valuables secure and not leave them unattended.

Children & Supervision

  • Children are welcome but must be supervised by a responsible adult at all times.
  • Staff are not responsible for babysitting or direct supervision of children in any area, including kids zones, play areas or during activities, unless specifically provided as a paid, organised programme.
  • Certain activities may not be suitable for young children and may have age or height restrictions.

Health, Fitness & Medical Conditions

By staying at the Resort and/or joining any activity, you confirm that:

  • You are in a condition that allows safe participation
  • You are not under any medical instruction that forbids such activities
  • You will inform us of any relevant medical or accessibility needs in advance

Guests with chronic illness, disability, pregnancy or other special conditions should seek medical advice before participating and disclose necessary information to our staff so we can assess suitability and possible accommodations.

The Resort may refuse participation or adapt activities for safety reasons. This is not discrimination; it is risk management for all guests.

Weather, Disruptions & Force Majeure

Activities and services may be delayed, modified or cancelled due to:

  • Heavy rain, storms, fog, landslides, flooding or unsafe trail conditions
  • Equipment malfunction
  • Power outages or infrastructure failure
  • Government orders, security concerns or other unforeseen operational issues

In such cases we will generally offer, at our discretion and subject to law, a reschedule to another available time or date, a voucher or credit valid for a future booking, or a refund (which may exclude bank/gateway fees).

We are not liable for additional expenses (transport, accommodation elsewhere, loss of time, etc.) arising from weather or operational disruptions, nor for failure or delay caused by events beyond our reasonable control — including natural disasters, extreme weather, pandemics, war, terrorism, civil unrest, strikes, government restrictions or similar events.

Website Use, Privacy & Cookies

You agree to use the website only for lawful purposes and not to disrupt, damage or interfere with its operation.

We may collect personal information such as your name, contact details, booking details and payment information to:

  • Process bookings and payments
  • Communicate with you about your stay or activities
  • Meet legal and regulatory requirements
  • Send you marketing updates where you have consented

Our Privacy Policy provides more detail on data collection, use and protection, and forms part of these Terms.

The website may use cookies or similar technologies for functionality and analytics. By using the site you consent to our use of cookies. You may adjust browser settings, but certain features may not work properly if cookies are disabled.

Intellectual Property

All text, images, logos, graphics and design on the Tongkaboti Nature Retreat website are owned by or licensed to us. You may view and print pages for personal, non-commercial use only. You may not copy, reproduce or distribute any content for commercial use without our written consent.

Photography & Media

The Resort may photograph or film parts of the property and certain activities for safety monitoring, marketing or documentation.

By entering the property and/or joining activities, you generally consent to the use of images or video where you may appear in the background or as part of a group.

If you do not wish to be clearly identifiable in promotional photos or videos, please inform our staff at check-in or before an activity, and we will take reasonable steps to respect your preference.

Pets

Unless explicitly allowed in writing, pets are not permitted in rooms, shared areas or activity zones — especially trails, rope courses and ground challenges — for safety and hygiene reasons.

Any permitted pets must be under full control of their owners at all times.

Limitation of Liability

To the maximum extent permitted by law, the Resort, its owners, directors, employees and agents are not liable for:

  • Indirect, incidental, special or consequential loss or damage
  • Loss of profits, business or opportunity
  • Injury, illness, death, property damage or other loss arising from your own acts or omissions, the actions of other guests or third parties, inherent risks of nature or adventure activities, weather or environmental conditions, or force majeure events

Where our liability cannot be excluded under applicable law, it will be limited to the total amount actually paid by you to the Resort for the specific booking or activity giving rise to the claim. Nothing in these Terms excludes any liability that cannot be excluded under Bangladeshi law.

Governing Law & Disputes

These Terms and any dispute arising from or related to your use of our Services shall be governed by and construed in accordance with the laws of Bangladesh.

You agree that any dispute which cannot be resolved amicably with Resort management shall be subject to the jurisdiction of the courts of Bandarban and/or Chattogram, Bangladesh.

Changes to These Terms

We may update or modify these Terms at any time. Updated Terms will be posted on our website with a revised “Last updated” date. Continued use of the website, property or Services after such changes constitutes your acceptance of the updated Terms.
